Introduction

This Acceptable Use Policy (“AUP”) governs your use of the Texas Divorce Express website, services, and online platform (collectively, the “Services”). By accessing or using our Services, you agree to comply with this AUP and all applicable laws and regulations.

Violation of this AUP may result in immediate termination of your access to our Services and may subject you to legal liability.

Geographic Restriction: Texas Jurisdiction

Texas-Only Service

Texas Divorce Express provides legal document preparation services exclusively for divorce and annulment proceedings filed in Texas courts under Texas family law.

Our Services are designed for:

  • Individuals filing for divorce or annulment in Texas courts
  • Cases where at least one spouse meets Texas residency requirements under Texas Family Code § 6.301
  • Cases subject to Texas family law

Texas Residency Requirements

Under Texas Family Code § 6.301, at least one spouse must have been a domiciliary of the State of Texas for the preceding six-month period and a resident of the county in which the suit is filed for the preceding 90-day period.

Under Texas Family Code § 6.302, if one spouse meets these residency requirements, the non-resident spouse may also file for divorce in Texas, subject to the following:

  • The suit must be filed in the county where the Texas-resident spouse lives
  • The non-resident spouse must properly serve the Texas-resident spouse
  • Long-arm jurisdiction rules may apply when neither party currently resides in Texas but Texas was the last matrimonial residence

Prohibition on Non-Texas Use

You may NOT use our Services if:

  • Neither you nor your spouse meets Texas residency requirements under Texas Family Code § 6.301
  • You intend to file in a state other than Texas
  • Your case will be governed by laws other than Texas law

Waiver of Claims from Other Jurisdictions

BY USING OUR SERVICES, YOU ACKNOWLEDGE AND AGREE:

  1. You or your spouse meets Texas residency requirements under Texas Family Code § 6.301, or you are eligible to file for divorce or annulment in Texas under Texas Family Code § 6.302

  2. You waive all claims against Texas Divorce Express, Attorney Stephanie Hoppas, and all affiliated persons and entities arising from:
    • Laws of jurisdictions other than Texas
    • Requirements of courts outside of Texas
    • Regulations or professional rules of other states
    • Any legal authority outside the State of Texas
  3. You hold harmless Texas Divorce Express from any damages, claims, or liability arising from:
    • Your use of our Services if neither you nor your spouse meets Texas residency requirements
    • Filing documents prepared by us in a non-Texas court
    • Reliance on our Services for matters governed by non-Texas law
    • Any violations of laws or professional rules outside Texas
  4. You accept full responsibility for any outcomes of using our Texas-specific Services for matters outside Texas jurisdiction

If neither you nor your spouse meets Texas residency requirements or you do not intend to file in Texas, DO NOT use our Services. Seek legal services appropriate to your jurisdiction.

Eligibility and Intended Use

Eligible Users

Our Services are intended for:

  • Adults (18 years of age or older)
  • Individuals seeking uncontested divorce or annulment in Texas
  • Individuals where at least one spouse meets Texas residency requirements under Texas Family Code § 6.301 or § 6.302
  • Users who can provide accurate and complete information

Ineligible Users

You may NOT use our Services if:

  • You are under 18 years of age
  • Neither you nor your spouse meets Texas residency requirements under Texas Family Code § 6.301 or § 6.302
  • Your case is contested or involves complex legal issues beyond our scope
  • You are subject to a court order prohibiting you from acting in your case
  • You have been previously banned from our Services

Prohibited Conduct

You agree NOT to:

Misuse of Services

  • Provide false, inaccurate, or misleading information
  • Impersonate another person or entity
  • Use our Services for any illegal or fraudulent purpose
  • Attempt to obtain services for someone else without their knowledge or consent
  • Use our Services to harass, threaten, or intimidate any person

Unauthorized Access

  • Access our Services through automated means (bots, scrapers, etc.)
  • Attempt to circumvent security measures or access controls
  • Share your account credentials with others
  • Access or use another person’s account without permission
  • Attempt to gain unauthorized access to our systems or networks

Interference with Services

  • Interfere with or disrupt our Services or servers
  • Introduce viruses, malware, or other harmful code
  • Attempt to overload, crash, or impair our systems
  • Engage in any activity that could damage our reputation or business

Misuse of Information

  • Use information obtained from our Services for spam or unsolicited marketing
  • Scrape, copy, or republish our content without permission
  • Use our Services to collect information about other users
  • Reverse engineer or attempt to extract source code from our platform
  • Use our Services for contested cases without notifying us
  • Submit filings to courts knowing they contain false information
  • Use our documents in jurisdictions other than Texas
  • Engage in unauthorized practice of law
  • Represent others without proper licensing

Appropriate Use of Services

Accurate Information

You must:

  • Provide truthful and accurate information
  • Update information if it changes
  • Notify us of errors or inaccuracies promptly
  • Respond honestly to all questions and forms

Good Faith Use

You must:

  • Use our Services in good faith for their intended purpose
  • Follow instructions and guidance provided
  • Cooperate with reasonable requests for information
  • Act ethically and honestly throughout the process

Compliance with Law

You must:

  • Comply with all applicable Texas and federal laws
  • Follow court rules and procedures
  • Respect the rights of your spouse and others
  • Notify us if legal issues or complications arise in your case

Attorney-Client Relationship

No Automatic Relationship

Important: Simply using our website or Services does not create an attorney-client relationship. An attorney-client relationship is established only when:

  1. You retain our services for document preparation
  2. We agree in writing to provide those services
  3. Any required engagement agreement is signed

Limited Scope Representation

Our Services provide limited scope representation for document preparation only. We do NOT:

  • Provide full legal representation in court
  • Appear on your behalf at hearings (unless separately arranged)
  • Negotiate with your spouse or their attorney
  • Make strategic legal decisions for you
  • Guarantee any particular outcome

Your Responsibilities

When using our Services, you are responsible for:

  • Filing documents with the court, unless you purchase our filing service
  • Serving documents on your spouse
  • Attending court hearings (attorney hearing attendance may be arranged separately)
  • Providing testimony
  • Complying with court orders
  • Making final decisions about your case

Confidentiality and Privacy

Our Obligations

We will:

  • Maintain the confidentiality of your information in accordance with attorney-client privilege (once established)
  • Follow our Privacy Policy in handling your personal data
  • Use appropriate security measures to protect your information

Your Obligations

You must:

  • Not disclose your account credentials to others
  • Protect confidential information we provide
  • Follow our security recommendations
  • Notify us immediately of any security breach

Exceptions to Confidentiality

We may disclose your information when:

  • Required by law or court order
  • Necessary to prevent imminent harm
  • You provide explicit consent
  • Required to defend against legal claims

Payment and Fees

Payment Obligations

You agree to:

  • Pay all fees for Services you request
  • Provide accurate payment information
  • Pay court costs and fees directly to the court
  • Pay any third-party costs (service fees, etc.) directly to providers

Waiver of Disputed Charges After Document Download

BY DOWNLOADING PLEADINGS OR OTHER DOCUMENTS PREPARED BY TEXAS DIVORCE EXPRESS, YOU ACKNOWLEDGE AND AGREE that you waive the right to dispute any charges with your payment provider — including chargebacks or payment reversals — for the Services associated with those documents.

If you believe a charge is incorrect, you agree to contact Texas Divorce Express directly to resolve the matter before initiating any dispute with your payment provider.

No Refunds for Completed Services

Once documents are prepared and delivered, fees are generally non-refundable. See our separate refund policy for details.

Court Costs Are Separate

Our service fees do NOT include:

  • Court filing fees ($250-$350 typically)
  • Service of process fees ($50-$150 if needed)
  • Certified copy fees
  • Other court-related costs

You are responsible for paying these directly to the court or service providers, unless you purchase our filing service. Texas Divorce Express offers court filing as an additional flat-fee service. When you purchase filing through us, we submit your documents to the appropriate court on your behalf. Court filing fees remain your responsibility and are collected separately.

Intellectual Property

Our Content

All content on our website and in our Services is protected by copyright, trademark, and other intellectual property laws.

You may NOT:

  • Copy, reproduce, or redistribute our content
  • Use our trademarks or branding without permission
  • Create derivative works based on our content
  • Use our materials for commercial purposes

You may:

  • View and use our Services for your personal, non-commercial use
  • Print documents we prepare for your case
  • Use our materials as instructed for your legal proceedings

Your Content

By providing information or uploading documents to our Services, you grant us a limited license to:

  • Use the information to provide our Services
  • Store and process your documents
  • Share with service providers as necessary

You retain all rights to your personal information and documents.

Disclaimers

No Guarantees

We do NOT guarantee:

  • That your divorce or annulment will be granted
  • That courts will accept our documents without modification
  • Any specific timeline for completion
  • That all legal issues will be addressed
  • That you will achieve any particular outcome

Professional Judgment

While Attorney Stephanie Hoppas oversees our document preparation, you are responsible for:

  • Determining if our Services meet your needs
  • Deciding whether to use our Services or seek full representation
  • Making final decisions about your legal matter

Technical Issues

We are not liable for:

  • Website downtime or technical failures
  • Loss of data due to technical issues
  • Errors in third-party systems (courts, payment processors)

Limitation of Liability

Waiver of Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Texas Divorce Express, Attorney Stephanie Hoppas, and all affiliated persons and entities shall NOT be liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits or business opportunities
  • Emotional distress
  • Punitive damages
  • Damages exceeding the fees you paid for our Services

Your Assumption of Risk

You acknowledge and accept the risks of:

  • Using limited scope document preparation services
  • Representing yourself in legal proceedings
  • Filing in court without full legal representation

Termination

Our Right to Terminate

We may terminate or suspend your access to our Services immediately, without notice, if:

  • You violate this AUP
  • You provide false or misleading information
  • Neither you nor your spouse meets Texas residency requirements
  • Your case becomes contested or beyond our scope
  • We determine we cannot adequately serve your needs
  • Required by law or court order

Your Right to Terminate

You may stop using our Services at any time. However:

  • Fees for services already provided are non-refundable
  • We may retain your information as required by law
  • You remain bound by confidentiality obligations

Effect of Termination

Upon termination:

  • Your access to our Services ends immediately
  • You must cease using any materials we provided
  • Provisions surviving termination remain in effect
  • Outstanding payment obligations remain due

Dispute Resolution

Texas Law Governs

This AUP is governed by the laws of the State of Texas, without regard to conflict of law principles.

Venue and Jurisdiction

Any disputes arising from this AUP or our Services shall be resolved exclusively in the state or federal courts located in Bexar County, Texas.

By using our Services, you:

  • Consent to the exclusive personal jurisdiction of the state and federal courts located in Bexar County, Texas
  • Waive any objection to venue in Bexar County, Texas, including any claim of inconvenient forum
  • Agree that Texas law applies to all disputes

Waiver of Jury Trial

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND TEXAS DIVORCE EXPRESS EACH WAIVE THE RIGHT TO A JURY TRIAL for any claim, dispute, or controversy arising out of or relating to this AUP, the Services, or any transaction between you and Texas Divorce Express. This waiver applies to all causes of action, whether based in contract, tort, statute, or otherwise. You acknowledge that this waiver is knowing and voluntary.

No Class Actions

You agree to resolve disputes individually and waive any right to participate in class action lawsuits against us.

Changes to This Policy

We may modify this AUP at any time by:

  • Posting the updated AUP on our website
  • Updating the “Last Updated” date
  • Providing notice for material changes

Your continued use after changes are posted constitutes acceptance of the modified AUP.

Severability

If any provision of this AUP is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

This AUP, together with our Privacy Policy and any engagement agreement, constitutes the entire agreement between you and Texas Divorce Express regarding use of our Services.
