1. Service Description

Texas Divorce Express (“TDE,” “we,” “us,” or “our”) provides online legal document preparation services for uncontested divorce and annulment proceedings in the State of Texas. Our services include:

  • Document preparation based on information you provide through our online questionnaire
  • Secure document storage for your case-related files
  • Filing guidance with step-by-step instructions for submitting documents to your county court
  • Educational resources about the Texas divorce and annulment process

We prepare documents based on the Texas Family Code and the specific requirements of Texas courts. Our role is limited to document preparation – we do not represent you in court, negotiate on your behalf, or provide legal opinions about your case.

2. Eligibility

To use our services, you must meet all of the following requirements:

  • Age: You must be at least 18 years of age.
  • Texas residency: You or your spouse must have been a domiciliary of Texas for at least six months before filing, as required by Texas Family Code Section 6.301.
  • County residency: You or your spouse must have been a resident of the county where you plan to file for at least 90 days before filing, as required by Texas Family Code Section 6.301.
  • Uncontested case: Your divorce or annulment must be uncontested, meaning you and your spouse agree on all terms including property division, debt allocation, and – if applicable – child-related matters.
  • Accurate information: You must provide truthful, complete, and accurate information. We prepare documents based on what you tell us, and we cannot verify the accuracy of the information you provide.
  • Account: You must create an account and maintain the security of your login credentials.

If your case is contested, involves complex property or custody disputes, or requires court appearances, our service may not be appropriate for your situation. Our eligibility quiz is designed to help you determine whether our service is a good fit.

3. User Obligations

By using our services, you agree to:

  • Provide accurate information. You are solely responsible for the accuracy and completeness of all information you provide. Incorrect or incomplete information may result in documents that do not meet court requirements.
  • Review your documents. You are responsible for reviewing all documents we prepare before filing them with the court.
  • Comply with applicable law. You must comply with all applicable federal, state, and local laws when using our services.
  • Maintain account security. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
  • Use services for lawful purposes only. You may not use our services to prepare fraudulent documents, misrepresent facts to a court, or for any other unlawful purpose.
  • Respect our platform. You may not attempt to access unauthorized areas of our platform, interfere with our systems, or use automated tools to access our services.

4. Payment Terms

  • Pricing. Service fees are displayed at the time of purchase and are charged in U.S. dollars. Prices are subject to change, but any price change will not affect orders that have already been completed.
  • Payment methods. We accept credit cards, debit cards, and other payment methods as displayed at checkout. Payment is processed through secure third-party payment processors.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Texas Divorce Express, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services.
  • Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the total amount you paid to us for the specific service giving rise to the claim.

  • We cannot guarantee any particular outcome.
  • Communications between you and Texas Divorce Express are not protected by attorney-client privilege.

  • Informal resolution. Before filing any formal legal proceeding, you agree to contact us at the address below to attempt to resolve the dispute informally. We will attempt to resolve any dispute within 30 days of receiving notice.
  • Jurisdiction. Any legal action arising from or related to these Terms shall be filed exclusively in the state or federal courts located in Bexar County, Texas. You consent to the personal jurisdiction of these courts.
  • Limitation on claims. Any claim arising from or related to these Terms must be brought within one year after the cause of action accrues.

These Terms of Service and your use of our services are governed by the laws of the State of Texas. All document preparation services are performed in accordance with the Texas Family Code and applicable Texas court rules.
